Enforcement of registration and education requirements; advisory committee; rules.
Operative Text
(1) The Housing and Community Services Department shall adopt rules for the administration and enforcement of ORS 90.732 and 90.734. The rules shall include, but need not be limited to, a rule that establishes a schedule of civil penalties for noncompliance that is consistent with the amount limitation established under ORS 90.736. (2) The department shall appoint an advisory committee to advise the department in drafting the rules required by subsection (1) of this section and to assist the department in implementing and administering the duties of the department regarding the registration and continuing education requirements established in ORS 90.732 and 90.734. The advisory committee shall include representatives of interested parties, including but not limited to representatives of manufactured dwelling park landlords and representatives of manufactured dwelling park tenants.
ORS § 90.738 directs Oregon's Housing and Community Services Department to create rules for enforcing the manufactured dwelling park registration and continuing education requirements found in ORS 90.732 and 90.734. Those rules must include a civil penalty schedule for noncompliance, capped at the amount set by ORS 90.736. The department is also required to form an advisory committee—including representatives of both park landlords and park tenants—to help draft the rules and guide ongoing administration of these requirements.
Plain English — not legal advice.
Under ORS § 90.738, operators of manufactured dwelling parks are subject to civil penalties established by the Housing and Community Services Department for failing to meet the registration and continuing education obligations set out in ORS 90.732 and 90.734. Compliant park operators generally maintain current registration, complete required continuing education on schedule, and keep documentation that demonstrates ongoing compliance. Staying informed about the department's adopted rules and any updates to the penalty schedule helps operators avoid enforcement actions.

ORS § 90.738 gives manufactured dwelling park tenants a formal role in shaping the rules that govern their landlords: the Housing and Community Services Department must include tenant representatives on the advisory committee that helps draft and administer these regulations. If a tenant believes a park landlord is not meeting the registration or continuing education requirements of ORS 90.732 and 90.734, they may consider filing a complaint with the Housing and Community Services Department, which holds enforcement authority under this section. Tenant-rights organizations familiar with Oregon manufactured dwelling park law can help residents understand what the department's adopted rules require and what options may be available.
