ON _________, 2_____ AT _____ A.M./P.M., you must come to the County Court House located at _________. You do not have to pay any fees to the court for this first hearing.

• The judge may ask you to try to reach an agreement with your landlord, but this is voluntary. Trained mediators may be available free of charge to help resolve disputes.

• The court will schedule a trial if you and your landlord do not reach an agreement or if you do not agree to move out.

IF YOU WANT A TRIAL, YOU MUST:

• Show up in court at the time scheduled above;

• On the same day, file an Answer with the Court giving a legal reason why you should not be evicted (the Court can give you a form);

• Give a copy of the Answer to your landlord (or your landlord’s agent or attorney); and

• Pay a filing fee of $_____ (the judge may allow payment to be deferred in certain circumstances).

ORS § 105.113 establishes the specific form that a summons must take in residential eviction cases governed by ORS chapter 90 or ORS 91.120, overriding the general civil procedure rules found in ORCP 7. The required form must be made available through the court clerk and includes standardized notices to tenants about the hearing date, the consequences of appearing or not appearing, and the steps required to request a trial. The summons must also include any information required under ORS 408.515, unless an exception under that statute applies.

For Property Managers

Under ORS § 105.113, landlords or their agents initiating a residential eviction must use the court-prescribed summons form rather than a general civil summons. A compliant operator obtains the current form from the court clerk, fills in all required fields accurately — including the hearing date, property address, and plaintiff contact information — and ensures that any required ORS 408.515 disclosures are attached. Using a non-conforming summons in a case covered by ORS chapter 90 or ORS 91.120 can create procedural complications in the eviction proceeding.

For Tenants

ORS § 105.113 requires that tenants in residential eviction cases receive a standardized summons that clearly explains their rights and options, including the right to appear at the scheduled hearing, file an Answer with the court, and request a trial. If a tenant receives a summons that does not substantially match the form required by this provision, or is missing required ORS 408.515 information, that procedural defect may be relevant to the case. Tenants who have questions about a summons they have received can contact a local tenant-rights organization or the Oregon State Bar's Lawyer Referral Service for general guidance on next steps.
