Under 68 P.S. § 398.11a, when a manufactured home community is sold or leased, the current owner must give written notice to residents, tenants, and the Pennsylvania Housing Finance Agency within 30 days of signing any agreement of sale. That notice must be posted where the community's rules and regulations are displayed. Additionally, once the title actually transfers, the incoming owner has 30 days to inform all residents and tenants of the new owner's name and contact information, both by mail and by posting in the same designated location.

For Property Managers

Operators and owners of manufactured home communities in Pennsylvania should be aware that 68 P.S. § 398.11a creates two distinct notification obligations triggered at different points in a transaction. The first obligation arises at contract signing: written notice goes to residents, tenants, and the Pennsylvania Housing Finance Agency within 30 days and must be posted in the community's designated rules-and-regulations location. The second obligation falls on the new owner after title transfers: within 30 days, a mailed notice identifying the new owner and providing current contact information must reach every resident and tenant, with a simultaneous posting in the same conspicuous location.

For Tenants

Residents and tenants of manufactured home communities in Pennsylvania have a right under 68 P.S. § 398.11a to receive timely written notice whenever their community is being sold or leased. If a sale agreement has been signed and no notice has appeared within 30 days—either mailed or posted where community rules are displayed—that may represent a failure to comply with this provision. Tenants who believe these notice requirements have not been met may consider contacting a tenant-rights organization, reaching out to the Pennsylvania Housing Finance Agency, or consulting with a housing attorney to understand what options may be available.
