Cal. Civ. Code § 398.7
Appliance Installation Fees
Operative Text
No manufactured home community owner or operator may restrict the making of any interior improvements in a manufactured home so long as such improvements are in compliance with applicable building codes and other provisions of law; nor may he restrict the installation, service or maintenance of an electric or gas appliance in a manufactured home or charge any fee for such installation unless the fee reflects the actual cost to the manufactured home community owner or operator of such installation or its use. (7 amended Oct. 19, 2010, P.L.546, No.80) Compiler's Note: Section 5 of Act 80 of 2010, which amended section 7, provided that Act 80 shall apply to: (1) New sales and leases of manufactured home community spaces entered into after the effective date of section 5. (2) Extensions and renewals of leases of manufactured home community spaces entered into after effective date of section 5.
Under 68 P.S. § 398.7, manufactured home community owners and operators are prohibited from blocking residents from making interior improvements to their own homes, as long as those improvements comply with applicable building codes and other laws. Similarly, community owners and operators cannot restrict the installation, servicing, or maintenance of electric or gas appliances inside a manufactured home. If a community owner or operator does charge a fee related to appliance installation, that fee must reflect only the actual cost incurred by the community owner or operator — not an arbitrary or profit-driven amount.

Under 68 P.S. § 398.7, compliant manufactured home community operators generally refrain from placing blanket restrictions on residents' interior home improvements and appliance installations. When a fee is charged in connection with appliance installation, operators document and charge only the actual costs they incur, keeping records that substantiate those figures. Operators also review any new leases, lease extensions, or renewals entered into after the effective date of Act 80 of 2010 to ensure their terms align with the requirements of this provision.

Section 68 P.S. § 398.7 gives manufactured home residents the right to make interior improvements and install, service, or maintain electric or gas appliances without community owner interference, provided applicable building codes are followed. If a community owner or operator charges an appliance installation fee that appears to exceed their actual costs, or attempts to restrict such work outright, that may constitute a violation of this provision. Residents who believe their rights under § 398.7 have been violated can document the situation, review their lease terms, and consider reaching out to a tenant-rights organization or the Pennsylvania Attorney General's office for general information about available options.
