R.I. Gen. Laws ch. 31-44.2 § 31-44.2-10
Severability
Operative Text
If any provision of this chapter or the application thereof to any person or circumstances is held invalid, the invalidity does not affect other provisions or application of this chapter which can be given effect without the invalid provision or application, and to this end the provisions of this chapter are severable.
Rhode Island General Laws § 31-44.2-10 establishes a severability rule for the chapter, meaning that if any single part of the law is found legally invalid by a court, that finding does not automatically invalidate the rest of the chapter. The remaining provisions continue to operate independently, as long as they can function without the struck portion. This is a standard legal mechanism designed to preserve as much of the statute as possible when one element is challenged.
Plain English — not legal advice.
Section 31-44.2-10 provides assurance that the regulatory framework landlords operate under remains largely intact even if a court invalidates one specific provision. Compliant operators generally continue following all other requirements of the chapter without interruption when a single rule is struck down. Staying informed about any court decisions affecting specific provisions of this chapter helps property managers understand which obligations remain in force.

Under § 31-44.2-10, tenants retain the protections afforded by the rest of the chapter even if one particular provision is successfully challenged in court. This means that a legal ruling narrowing one part of the law does not erase other rights or remedies available under the chapter. Tenants who have questions about how a specific court ruling may affect their protections can consult a tenant-rights organization or legal aid provider for general guidance.
