R.I. Gen. Laws ch. 34-18 § 34-18-21
At the commencement of the term a landlord shall deliver possession of the premises
to the tenant in compliance with the rental agreement and § 34-18-22. The landlord may bring an action for possession against any person wrongfully in
possession and may recover the damages provided in § 34-18-38(c).

Plain English

Rhode Island General Laws § 34-18-21 establishes that at the start of a tenancy, the landlord is obligated to hand over the rental unit in a condition that meets the terms of the rental agreement and the habitability standards set out in § 34-18-22. If someone is unlawfully occupying the premises and preventing that handover, the law gives the landlord a legal avenue to reclaim possession and seek monetary damages under § 34-18-38(c). This provision essentially sets the baseline expectation that a tenant receives what was promised, starting on day one of the lease term.

For Property Managers

Under § 34-18-21, compliant operators ensure the rental unit is vacant, accessible, and in the condition promised in the lease before the tenant's move-in date. This means coordinating with prior occupants well in advance and confirming the unit meets the habitability standards referenced in § 34-18-22 before the term begins. When a holdover occupant or other party refuses to vacate, Rhode Island law provides a legal action for possession and a damages remedy under § 34-18-38(c) to address that situation.

For Tenants

Section § 34-18-21 of Rhode Island law gives tenants the right to actually receive possession of their unit at the start of the lease term, in the condition the rental agreement and § 34-18-22 require. If a landlord fails to deliver the unit as promised — whether because a prior tenant is still present or the unit is not in the agreed condition — this provision may be relevant to any dispute or complaint a tenant pursues. Tenants who encounter this situation may consider reaching out to a local tenant-rights organization or Rhode Island Legal Services to understand the options available under this provision.
