R.I. Gen. Laws ch. 45-24.2 § 45-24.2-6
Court review
Operative Text
Any person, including the enforcing officer, aggrieved by any decision of the board, whether established by § 45-24.3-16 or by any ordinance, rule, or regulation passed pursuant either to this chapter or to any special act governing minimum housing, may appeal a decision to the district court encompassing the area wherein the real estate is located. Appeal shall be made by filing a complaint with the court stating the facts upon which the appeal is based and setting forth the reasons for the appeal. The complaint shall be filed within thirty (30) days after mailing notice of the final decision of the board, and copies of the complaint shall be served upon the board and all other parties of record in the manner prescribed by applicable procedural rules of the district court. A party aggrieved by any judgment of the district court may seek further review by the supreme court in accordance with § 8-8-3.2(b).
Rhode Island General Laws § 45-24.2-6 establishes a formal appeals pathway for anyone—including enforcement officers—who disagrees with a housing board's decision. A written complaint must be filed in the district court covering the property's location within 30 days of the board mailing its final decision, and copies must be served on the board and all parties of record. If the district court's judgment is also unsatisfactory, the losing party may seek further review before the Rhode Island Supreme Court under § 8-8-3.2(b).

Under § 45-24.2-6, property owners who receive an adverse board ruling have a defined window—30 days from the mailing of the board's final decision—to file a district court appeal. Compliant operators typically track the mailing date carefully, prepare a complaint that clearly states the factual basis and reasons for the appeal, and ensure that copies are properly served on the board and all parties of record. If the district court rules against them, operators should be aware that a further avenue of review exists at the Rhode Island Supreme Court level.

Section 45-24.2-6 gives tenants who are parties of record the same right to appeal a housing board decision to the district court as any other aggrieved party. Tenants generally preserve this right by filing a complaint within 30 days of the board's mailing of its final decision and serving copies on the board and other parties as required by district court procedural rules. Tenant-rights organizations and legal aid offices can help tenants understand whether they qualify as an aggrieved party and what the procedural requirements mean in practice.
