515 R.I. Code R. 10-00-2 § 515-RICR-10-00-2 § 2.17
Reopening of Proceedings
Operative Text
Authorization of Commission. After issuing any Decision and Order pursuant to § 2.16 of this Part, the Commission, on its own motion, whenever justice so requires, and after reasonable notice and opportunity to be heard have been given to all parties, may reopen any proceeding and take such action as it may deem necessary, including modifying or setting aside, in whole or part, any finding or Order previously made by it.
Under 515 RICR 10-00-2 § 2.17, the Commission retains authority to revisit any proceeding after it has issued a Decision and Order under § 2.16. Acting on its own initiative when justice requires, the Commission may reopen a case, and it must first provide all parties with reasonable notice and a chance to be heard. Once reopened, the Commission can modify or set aside any prior finding or order, in whole or in part.

Property owners and managers subject to a Commission Decision and Order should be aware that, under 515 RICR 10-00-2 § 2.17, the matter may not be fully closed even after a final ruling under § 2.16. Compliant operators generally maintain thorough records of all proceedings and correspondence so they can respond promptly if the Commission exercises its authority to reopen a case. Because the Commission acts on its own motion, operators benefit from staying informed about any notices issued after a Decision and Order is entered.

Section 515 RICR 10-00-2 § 2.17 means that a Commission Decision and Order is not necessarily the last word — the Commission itself can reopen a proceeding when justice requires, even without a party's request. Tenants who are parties to a Commission proceeding are entitled to reasonable notice and an opportunity to be heard before any reopened proceeding moves forward. Those who believe a prior ruling should be revisited may wish to consult a tenant-rights organization or legal aid provider to understand what options exist under this provision.
