(B) Plans for all construction or alterations affected by this chapter must be submitted to the appropriate official by the project owner, architect, or contractor for preconstruction review and approval. Each submittal shall consist of at least one set of project drawings and specifications, project name or description, street address or location, and the owner's name and address. (C) Compliance with this article, including conducting compliance investigations, must be carried out by the officials, enumerated in this section, within their respective jurisdictions.
Section 10-5-270 of the South Carolina Code establishes a mandatory pre-construction review and approval process for buildings, structures, and facilities subject to the state's accessibility and construction compliance chapter. Before any construction or alteration begins, plans must be routed to a specific designated official—determined by the type of facility and jurisdiction—who is responsible for verifying compliance. The required submission package must include at minimum one set of drawings and specifications, a project name or description, a street address or location, and the owner's name and address. Compliance investigations under this article are also carried out by these same designated officials within their respective jurisdictions.

Under S.C. Code Ann. § 10-5-270, property owners involved in construction or alteration projects are generally expected to identify the correct reviewing authority before breaking ground—whether that is the State Engineer, a state agency director, a local building official, or the Building Codes Council administrator, depending on the facility type and location. A compliant project owner typically submits a complete package—including drawings, specifications, project description, address, and owner contact information—to the appropriate official for preconstruction review and approval. Operators who manage multiple property types or jurisdictions should confirm which official has authority over each specific project, since the routing requirement varies by facility category.

S.C. Code Ann. § 10-5-270 establishes that buildings and facilities subject to this chapter must receive official plan approval before construction or alteration, which is a protection that can affect the accessibility and safety standards of residential and public-use spaces. If a tenant believes that a building was constructed or altered without the required preconstruction review and approval, that concern can generally be raised with the designated compliance official for the relevant jurisdiction—such as a local building official or the Building Codes Council administrator. Tenant-rights organizations and legal aid services can help individuals understand how this provision's compliance framework may relate to conditions in their housing.
