S.C. Code Ann. § 27-47-310
Written rental agreement required; items which must be provided for; restriction on user fee
Operative Text
(A) An owner who offers for lease a space in a manufactured home park shall provide to the resident an agreement in writing containing the terms by which the space is leased. The written agreement must comply with this section. (B) The duration of the lease must be stated in the agreement and may be of a length agreed upon by the owner and resident. (C) If the agreement provides an option for renewal, the amount of rent to be paid for tenancy during the option must be stated in the agreement. (D) The rental agreement must specify: (1) location and approximate size of the lot leased pursuant to the agreement; (2) monthly rental rate; (3) date payment is due; (4) place of payment; (5) personal property, services, and facilities provided by the owner; (6) regulations governing residency which, if violated, may be cause for eviction; (7) statement of amounts to be paid by the resident including, but not limited to, security deposits, service fees, and installation charges; (8) improvements, if any, which the resident may make to the rental lot including landscaping; (9) improvements, if any, required to be made by the resident; (10) restrictions, if any, regarding pets, children, number of occupants, and vehicle storage; (11) notice required to exercise option for renewal or to terminate tenancy. (E) During the rental agreement a user fee must not be charged by the owner to the resident for a service or amenity which previously was provided and included in the lot rental amount unless there is a corresponding decrease in the amount within the terms of the contract.
Section 27-47-310 of the South Carolina Code requires that owners of manufactured home park spaces provide residents with a written lease agreement covering a defined set of terms. The agreement must spell out the lease duration, monthly rent, payment details, lot location and size, rules of residency, deposits and fees, permitted or required improvements, occupancy restrictions, and renewal or termination notice requirements. Additionally, the law prohibits a park owner from introducing a new user fee for a service or amenity that was previously included in the lot rental amount unless the base rent is reduced by a corresponding amount.
Plain English — not legal advice.
Under S.C. Code Ann. § 27-47-310, compliant manufactured home park operators prepare written lease agreements that address every item enumerated in the statute — including lot location, monthly rate, payment due date and place, services provided, residency regulations, deposits, improvement rights and obligations, occupancy restrictions, and renewal or termination notice procedures. When a renewal option is included, the rent amount for that option period is stated in the original agreement rather than left open. Operators also take care not to unbundle services or amenities that were previously covered by the lot rental amount into separate user fees without making a corresponding reduction to the base rent.

Section 27-47-310 gives manufactured home park residents in South Carolina the right to receive a written lease that clearly discloses the lot's location and size, the monthly rent, payment terms, all fees and deposits, residency rules, and any improvement or occupancy restrictions before or at the time of leasing. If a park owner attempts to charge a new user fee for something that was already included in the lot rent — without lowering the base rent accordingly — that practice is prohibited under this provision, and a resident may have grounds to raise that violation in a dispute or complaint proceeding. Tenants who believe their agreement is missing required terms or that an improper fee has been imposed may consider contacting a South Carolina tenant-rights organization or the appropriate state agency for guidance on available options.
