S.C. Code Ann. § 31-21-90
Administration of chapter
Operative Text
(A) The commission shall administer the provisions of this chapter. (B) The commission may delegate any of its functions, duties, and powers to its employees including functions, duties, and powers with respect to investigating, conciliating, hearing, determining, ordering, certifying, reporting, or otherwise acting as to any work, business, or matter under this chapter.
Section 31-21-90 of the South Carolina Code establishes that the commission is the body responsible for overseeing and carrying out the provisions of Chapter 21. The commission is also authorized to assign its investigative, conciliatory, hearing, and decision-making responsibilities to its own employees. This delegation authority allows the commission to distribute its workload across staff while retaining overall accountability for the chapter's administration.
Plain English — not legal advice.
Under S.C. Code Ann. § 31-21-90, the commission—and any employees to whom it has delegated authority—serves as the governing body overseeing Chapter 21 compliance. Property owners and managers generally direct inquiries, responses to investigations, and other official communications to the commission or whichever designated employee has been assigned a particular matter. Staying informed about which commission representative is handling a given proceeding helps operators engage with the correct point of contact.

S.C. Code Ann. § 31-21-90 makes clear that the commission holds administrative authority over Chapter 21 and may assign its investigative and hearing functions to designated employees. If a tenant believes a matter under this chapter warrants attention, the commission—or a staff member acting under delegated authority—is the appropriate body to contact. Tenant-rights organizations familiar with South Carolina housing law can help individuals understand how to engage with the commission's processes.
