Plain English

Under S.C. Code Ann. § 31-3-50, public housing authorities in South Carolina are permitted to reach out to the state Department of Revenue and the Department of Employment and Workforce to help confirm whether an applicant or resident qualifies for a public housing program. These requests can be submitted electronically or in writing, but must clearly identify the specific information sought and include enough identifying details to pinpoint the correct individual. When electronic communication is used for either the request or the response, a follow-up written copy must also be sent to the relevant party.

For Property Managers

Public housing authorities operating under S.C. Code Ann. § 31-3-50 generally maintain eligibility verification procedures that include formal, documented requests to the Department of Revenue and the Department of Employment and Workforce. Compliant authorities ensure that each request specifies exactly what information is needed and provides sufficient identifying details about the individual in question. When electronic means are used, operators typically retain and forward written copies of both requests and responses to satisfy the statute's documentation requirement.

For Tenants

S.C. Code Ann. § 31-3-50 governs how a public housing authority may gather income and employment information from state agencies to verify a resident's or applicant's eligibility for a public housing program. If you believe information obtained through this process was inaccurate or improperly used in an eligibility determination, you may have grounds to raise that concern through the housing authority's grievance process. Tenant-rights organizations in South Carolina can help explain what records were requested, what responses were received, and what options may be available to address any errors.
