Tenn. Comp. R. & Regs. 0770-03-01 § 0770-03-01-.10 establishes that income limit schedules for Tennessee's Moderate Rehabilitation Program align with federal standards set under 24 CFR 882.112(c). The rule further requires that at least 30 percent of units under a Moderate Rehabilitation Contract be leased to Very Low-Income Families, to the maximum extent feasible. The administering Agency is also obligated to ensure that at least 30 percent of all families it assists across both the Moderate Rehabilitation and Existing Housing Programs qualify as Very Low-Income Families.
Plain English — not legal advice.
Under § 0770-03-01-.10, owners participating in Tennessee's Moderate Rehabilitation Program are contractually bound to lease at least 30 percent of their covered units to Very Low-Income Families, to the maximum extent feasible. Compliant operators generally track the income qualifications of their tenant mix against the income limit schedules referenced in 24 CFR 882.112(c) and maintain documentation demonstrating ongoing adherence to this threshold. Owners should also be aware that the Agency may refer Very Low-Income Families to their properties as part of its broader program administration obligations.

Section 0770-03-01-.10 establishes a meaningful set-aside requiring that at least 30 percent of units in Tennessee's Moderate Rehabilitation Program be made available to Very Low-Income Families, which may expand housing access for qualifying households. Tenants who believe they qualify as Very Low-Income Families and are seeking assistance may find it useful to contact the administering Agency directly, as the rule authorizes the Agency to refer such families to participating owners or provide assistance through the Existing Housing Program. Tenant-rights organizations familiar with Tennessee's housing programs can help individuals understand whether they fall within the income limits defined by reference to 24 CFR 882.112(c) and what options may be available to them.
