Cal. Civ. Code § 0770-03-02-.14
REEXAMINATION OF FAMILY INCOME AND COMPOSITION.
Operative Text
(a) A reexamination of Family Income, composition and redetermination of Gross Family Contribution will be conducted by the Agency. A Family’s eligibility for housing assistance payments will continue until the amount payable by the Family equals the Gross Rent for the dwelling unit it occupies. However, the termination of eligibility at that point will not affect the Family’s other rights under the lease. Any resumption of housing assistance payments as a result of subsequent changes in income or rents or other relevant circumstances will be contingent upon the availability of assistance under the Contract. A Family may at any time request a redetermination of its Gross Family Contribution on the basis of changes in Family Income or other relevant circumstances. Authority: T.C.A. §13-23-115(18). Administrative History: Original rule filed July 13, 1982; effective August 12, 1982.
Under Tenn. Comp. R. & Regs. 0770-03-02 § 0770-03-02-.14, the administering agency periodically reviews a participating family's income and household composition to recalculate how much the family owes toward rent. A family's housing assistance continues until the amount the family is required to pay equals the full gross rent of the unit, at which point assistance ends—though the family's rights under the lease remain intact. If income, rent levels, or other relevant circumstances change after assistance ends, the family may become eligible again, subject to whether funding is available under the applicable contract.

Operators participating in the housing assistance program governed by § 0770-03-02-.14 should be aware that the Agency—not the landlord—conducts periodic reexaminations of tenant income and household composition. Compliant operators generally maintain accurate lease terms and cooperate with Agency requests for information needed to support these reviews. Because a family's lease rights continue even after housing assistance payments end, operators typically honor all remaining lease obligations regardless of a tenant's subsidy status.

Section 0770-03-02-.14 gives families the right to request a redetermination of their required rent contribution at any time if their income or household circumstances change—families do not have to wait for a scheduled review. Even if housing assistance payments stop because a family's required contribution reaches the full gross rent, the family retains all other rights under the lease. Tenants who believe their contribution has been calculated incorrectly or who experience a change in circumstances may consider contacting the administering Agency directly or reaching out to a local tenant-rights organization for guidance on how to request a review.
