ACCESSIBILITY REQUIRED.
Operative Text
Sec. 2306.6730. ACCESSIBILITY REQUIRED. A project to which a low income housing tax credit is allocated under this subchapter shall comply with the accessibility standards that are required under Section 504, Rehabilitation Act of 1973 (29 U.S.C. Section 794), as amended, and specified under 24 C.F.R. Part 8, Subpart C. Added by Acts 2001, 77th Leg., ch. 1367, Sec. 8.01, eff. Sept. 1, 2001.
Under Tex. Gov't Code § 2306.6730, any housing development that receives a low income housing tax credit allocation in Texas must meet the federal accessibility standards established by Section 504 of the Rehabilitation Act of 1973 and detailed in 24 C.F.R. Part 8, Subpart C. These standards are designed to ensure that housing developments receiving this public subsidy are accessible to people with disabilities. The rule applies at the project level, meaning the entire development — not just individual units — must conform to these requirements.
Plain English — not legal advice.
Operators and developers of low income housing tax credit properties in Texas are expected, under § 2306.6730, to build and maintain their projects in compliance with Section 504 of the Rehabilitation Act and the implementing regulations at 24 C.F.R. Part 8, Subpart C. Compliant operators typically conduct accessibility reviews during design and construction, ensure that a required percentage of units meet mobility and sensory accessibility standards, and maintain documentation of compliance for regulatory audits. Failure to meet these standards can jeopardize a project's tax credit allocation and expose the development to federal civil rights scrutiny.

Tenants living in or applying to a low income housing tax credit property in Texas have a right to expect that the development meets the federal accessibility standards mandated by § 2306.6730, including those under Section 504 of the Rehabilitation Act and 24 C.F.R. Part 8, Subpart C. If a tenant believes a property is not meeting these accessibility requirements, general enforcement paths include filing a complaint with the U.S. Department of Housing and Urban Development, raising the issue with the Texas Department of Housing and Community Affairs, or contacting a local tenant-rights or disability-rights organization for guidance. Accessibility violations in federally assisted housing can also be raised as part of a broader fair housing complaint process.
