Plain English

Section 2306.921 of the Texas Government Code establishes the foundational definitions that govern the subchapter regulating migrant labor housing. Key terms defined include 'facility' (a structure or group of structures with surrounding land), 'migrant agricultural worker' (a person who moves between locations for seasonal or temporary agricultural work), 'migrant labor housing facility' (any facility used for more than three days as living quarters for two or more migrant families or three or more migrant workers), and 'person' (any individual or legal entity). These definitions set the scope of who and what is covered by the subchapter's requirements, regardless of whether rent is charged.

For Property Managers

Property owners and operators who provide housing to seasonal or temporary agricultural workers should understand that Tex. Gov't Code § 2306.921 defines the threshold at which a facility becomes a regulated 'migrant labor housing facility'—generally when it houses two or more migrant families or three or more migrant workers for more than three days. Compliant operators typically assess whether their property meets these definitional criteria before determining which regulatory obligations apply to them. Because the definition applies whether or not rent is collected, operators who provide housing at no charge are not exempt from the subchapter's reach.

For Tenants

Migrant agricultural workers and their families should be aware that Tex. Gov't Code § 2306.921 defines the types of housing arrangements that fall under this subchapter's protections, including facilities used for as few as three days when housing two or more migrant families or three or more workers. Understanding whether a living situation meets the definition of a 'migrant labor housing facility' is a first step in determining what rights and standards may apply. Tenant-rights organizations familiar with agricultural worker housing in Texas can help individuals assess whether their housing arrangement falls within the scope of this subchapter.
