Texas Health & Safety Code §§ 341.001–341.002 grants the executive commissioner of the Texas Health and Human Services Commission authority to adopt rules aimed at sanitation and health protection. These rules can establish standards and procedures for managing and controlling sanitation conditions as well as broader public health measures. The provision sets the regulatory foundation that underlies the more specific nuisance and sanitation requirements found throughout Chapter 341.
Plain English — not legal advice.
Under Tex. Health & Safety Code § 341.002, the executive commissioner's adopted rules and standards form the baseline sanitation and health requirements that property operators are expected to meet. Compliant operators generally stay informed of current administrative rules issued under Chapter 341, since those rules carry the same legal weight as the statute itself. Reviewing the Texas Health and Human Services Commission's published standards periodically helps operators understand what sanitation conditions and management procedures are required of residential properties.

Tex. Health & Safety Code § 341.002 is the authority behind the sanitation and health-protection rules that apply to residential living conditions in Texas. Tenants who believe a property fails to meet the standards adopted under Chapter 341 can document the conditions and raise those violations when communicating with landlords, local health authorities, or tenant-rights organizations. Local health departments and the Texas Health and Human Services Commission are among the bodies that administer and enforce rules issued under this provision.
