BUILDING LINES
Under Tex. Loc. Gov't Code § 214.103, Texas has adopted the International Swimming Pool and Spa Code (as it existed on May 1, 2019) as the statewide baseline standard for swimming pool and spa construction, alteration, remodeling, enlargement, and repair within municipalities. Municipalities that choose to regulate pools and spas may adopt a more recent version of the code and may establish local amendments, but any local code provision that conflicts with Texas state law or regulations on pool operation, water quality, safety, signage, or enclosures must yield to the state rule. This framework sets a uniform floor of safety and construction standards while preserving some local flexibility.

Property owners and managers who operate or construct swimming pools or spas within a Texas municipality should be aware that § 214.103 establishes the International Swimming Pool and Spa Code as the governing construction and design standard. Compliant operators generally verify which version of the code their municipality has adopted—since local governments may have adopted a post-2019 edition or local amendments—and ensure that any construction, remodeling, or repair work meets those requirements. Checking with the local municipal authority is a common step operators take to confirm whether local amendments or more recent code editions apply to their property.

Tenants who live in a property with a swimming pool or spa in Texas have an interest in knowing that § 214.103 sets baseline construction and safety standards for those amenities through the International Swimming Pool and Spa Code. If a pool or spa appears to be unsafe or improperly constructed, tenants can look to their municipality's building or code enforcement office, which is generally responsible for administering and enforcing the code under § 214.103(d). Tenant-rights organizations and local housing agencies can help residents understand what standards apply in their specific municipality and what complaint or reporting processes may be available.
