Section 301.0015 of the Texas Property Code establishes that the Texas Workforce Commission (TWC) is the state agency responsible for administering and enforcing the fair housing and anti-discrimination duties previously held by the Commission on Human Rights. Any reference to 'the commission' throughout Chapter 301 refers to the Texas Workforce Commission. This transfer of authority took effect in 2004 and was further updated by legislation in 2015.

For Property Managers

Under Tex. Prop. Code § 301.0015, the Texas Workforce Commission is the designated state body overseeing fair housing compliance in Texas. Compliant property owners and managers are generally aware that complaints, investigations, and enforcement actions related to Chapter 301 are handled through the TWC rather than any predecessor agency. Keeping current on which agency administers these rules helps operators respond appropriately to any official correspondence or inquiry.

For Tenants

Tex. Prop. Code § 301.0015 clarifies that the Texas Workforce Commission holds the authority to receive and act on fair housing complaints under Chapter 301. Tenants who believe their rights under this chapter have been violated may consider filing a complaint directly with the TWC, which inherited full enforcement powers from the former Commission on Human Rights. Tenant-rights organizations in Texas can help individuals understand the complaint process and what documentation may be relevant.
