Section 301.002 of the Texas Property Code sets out the overarching goals of the Texas Fair Housing Act. The chapter is designed to ensure fair housing practices across the state, establish a process for investigating and resolving complaints about discriminatory housing practices, and provide rights and remedies that are substantially equivalent to those available under federal fair housing law. This provision functions as a statement of legislative intent that shapes how the rest of the chapter is interpreted and applied.
Plain English — not legal advice.
Under Tex. Prop. Code § 301.002, Texas property owners and managers operate within a framework that mirrors federal fair housing protections. Compliant operators generally maintain non-discriminatory policies in advertising, leasing, and property management to align with the fair housing practices the chapter is designed to uphold. Understanding that this chapter was crafted to match federal standards helps operators recognize that both state and federal enforcement mechanisms may be relevant to their practices.
