Tex. Prop. Code Ann. §§ 301.001–301.171 § 301.026
RESIDENTIAL REAL ESTATE RELATED TRANSACTION.
Operative Text
Sec. 301.026. RESIDENTIAL REAL ESTATE RELATED TRANSACTION. (a) A person whose business includes engaging in residential real estate related transactions may not discriminate against another in making a real estate related transaction available or in the terms or conditions of a real estate related transaction because of race, color, religion, sex, disability, familial status, or national origin.(b) In this section, "residential real estate related transaction" means:(1) the making or purchasing of loans or the provision of other financial assistance:(A) to purchase, construct, improve, repair, or maintain a dwelling; or(B) to secure residential real estate; or(2) the selling, brokering, or appraising of residential real property. Added by Acts 1993, 73rd Leg., ch. 268, Sec. 40, eff. Sept. 1, 1993.
Section 301.026 of the Texas Property Code prohibits businesses that engage in residential real estate related transactions—such as making loans, providing financial assistance for housing, selling, brokering, or appraising residential property—from discriminating on the basis of race, color, religion, sex, disability, familial status, or national origin. The rule applies both to whether a transaction is made available at all and to the specific terms or conditions offered. This provision mirrors federal fair housing principles and extends them explicitly under Texas state law.
Plain English — not legal advice.
Property owners and managers who participate in residential real estate related transactions—including financing arrangements, sales, or appraisals—are expected under § 301.026 to apply consistent, non-discriminatory criteria across all applicants and counterparties regardless of race, color, religion, sex, disability, familial status, or national origin. Compliant operators typically document their transaction criteria uniformly and train staff to apply those criteria without reference to protected characteristics. Lenders, brokers, and appraisers working with residential properties are equally covered by this section.

Section 301.026 gives individuals the right to be free from discrimination when seeking financing, appraisals, or other residential real estate related services based on protected characteristics such as race, disability, or familial status. If a person believes they have been denied a loan, offered worse terms, or otherwise treated differently because of a protected characteristic, they may file a complaint with the Texas Workforce Commission Civil Rights Division or the U.S. Department of Housing and Urban Development, or consult a tenant-rights or fair housing organization for guidance on available remedies. Keeping records of communications, offers, and denials can be relevant when pursuing any of these paths.
