Section 94.002 of the Texas Property Code defines the specific relationships to which Chapter 94 applies. The chapter covers only the landlord-tenant relationship in a manufactured home community where the tenant leases land for the purpose of placing a manufactured home on it. Notably, the chapter does not extend to situations where a landlord owns and rents out the manufactured home itself, where land is leased for other types of human habitation structures, or where the relationship is between a landlord and their own employee or agent.
Plain English — not legal advice.
Under § 94.002, operators of manufactured home communities should understand that Chapter 94's protections and obligations apply specifically when they lease land to tenants who place their own manufactured homes on that land. If a landlord instead owns the manufactured home and rents it directly to a tenant, or if the occupant is an employee or agent, the landlord-tenant relationship falls outside this chapter's scope. Operators generally maintain clear lease documentation that identifies the nature of the tenancy to ensure the correct legal framework is applied.

Section 94.002 establishes whether the protections of Texas Property Code Chapter 94 apply to a given living arrangement. If you lease land in a manufactured home community and place your own manufactured home on it, this chapter's tenant protections are generally available to you. Tenants who are uncertain whether their specific arrangement qualifies under § 94.002 may benefit from consulting a tenant-rights organization or reviewing resources provided by the Texas State Law Library.
