Operative Text
Sec. 94.051. INFORMATION TO BE PROVIDED TO PROSPECTIVE TENANT. At the time the landlord receives an application from a prospective tenant, the landlord shall give the tenant a copy of:(1) the proposed lease agreement for the manufactured home community;(2) any manufactured home community rules; and(3) a separate disclosure statement with the following prominently printed in at least 10-point type:"You have the legal right to an initial lease term of six months. If you prefer a different lease period, you and your landlord may negotiate a shorter or longer lease period. After the initial lease period expires, you and your landlord may negotiate a new lease term by mutual agreement. Regardless of the term of the lease, the landlord must give you at least 60 days' notice of a nonrenewal of the lease, except that if the manufactured home community's land use will change, the landlord must give you at least 180 days' notice. During the applicable period, you must continue to pay all rent and other amounts due under the lease agreement, including late charges, if any, after receiving notice of the nonrenewal." Added by Acts 2001, 77th Leg., ch. 801, Sec. 1, eff. April 1, 2002. Amended by Acts 2003, 78th Leg., ch. 75, Sec. 2, eff. May 16, 2003.Amended by: Acts 2007, 80th Leg., R.S., Ch. 863 (H.B. 1460), Sec. 65, eff. January 1, 2008.
Under Texas Property Code § 94.051, when a landlord in a manufactured home community receives a rental application, they are required to hand the prospective tenant three documents: a copy of the proposed lease, any community rules, and a specific disclosure statement. That disclosure statement must be printed in at least 10-point type and inform the applicant of their right to an initial six-month lease term, the ability to negotiate different or subsequent lease periods, and the notice requirements—at least 60 days for a standard nonrenewal or at least 180 days if the land use of the community is changing. The rule ensures prospective tenants have key information about their rights before they commit to a lease.
Plain English — not legal advice.
Operators of manufactured home communities in Texas must comply with § 94.051 at the moment an application is received—not after approval or at lease signing. A compliant operator keeps ready-to-distribute packets containing the proposed lease agreement, all current community rules, and a properly formatted disclosure statement with the required language printed in no smaller than 10-point type. Maintaining consistent documentation practices and updating the disclosure packet whenever community rules or lease terms change are hallmarks of operators who stay in compliance with this provision.

Section § 94.051 of the Texas Property Code gives prospective manufactured home community tenants the right to receive three specific documents at the time they submit an application, including a disclosure statement that outlines your right to an initial six-month lease term and the notice periods a landlord must follow before nonrenewal. If a landlord fails to provide these materials at application time, that omission may be relevant to any later dispute about lease terms or notice rights, and raising it with a tenant-rights organization or housing authority can help clarify available options. Tenants who believe this provision was not followed may also consult the Texas State Law Library's self-help resources or seek guidance from a local legal aid office familiar with manufactured housing regulations.
