Under Tex. Prop. Code § 94.204, a landlord who operates a manufactured home community may decline to renew a lease when the underlying land is being converted to a different use, but only if proper advance notice is given at least 180 days before the change takes effect. That notice must be sent directly to the tenant, the manufactured home's owner (if different from the tenant), and any lienholder on the home, and must also be posted conspicuously within the community. The notice must identify the specific date of the land-use change and inform all relevant parties that the home will need to be relocated.

Operators of manufactured home communities considering a land-use conversion should be aware that Tex. Prop. Code § 94.204 sets a strict 180-day advance-notice requirement before any lease nonrenewal tied to that change can take effect. A compliant operator typically sends written notice to the tenant, the home's owner if different, and any known lienholder—specifying the change date and the relocation requirement—while simultaneously posting a conspicuous community-wide notice. Landlords are only obligated to notify a home's owner or lienholder if they have been provided written notice of that party's name and address.

Tex. Prop. Code § 94.204 gives tenants in manufactured home communities meaningful protection when a landlord seeks to convert the land to another use: the landlord must provide at least 180 days' written notice before the change, giving residents time to arrange relocation of their homes. If a landlord attempts to end a lease for land-use reasons without meeting these notice requirements, that failure may be relevant to any dispute over the nonrenewal. Tenants who believe proper notice was not given may wish to consult a tenant-rights organization or legal aid provider familiar with Texas manufactured housing law to understand available options.
