Tex. Prop. Code Ann. §§ 94.001–94.303 § 94.257
POSSESSION OF FIREARM OR FIREARM AMMUNITION ON LEASED PREMISES.
Operative Text
Sec. 94.257. POSSESSION OF FIREARM OR FIREARM AMMUNITION ON LEASED PREMISES. Unless possession of a firearm or firearm ammunition on a landlord's property is prohibited by state or federal law, a landlord may not prohibit a tenant or a tenant's guest from lawfully possessing, carrying, transporting, or storing a firearm, any part of a firearm, or firearm ammunition:(1) in the tenant's manufactured home;(2) in a vehicle located in a parking area provided for tenants or tenants' guests by the landlord of the leased premises; or(3) in other locations controlled by the landlord as necessary to:(A) enter or exit the tenant's manufactured home;(B) enter or exit the leased premises; or(C) enter or exit a vehicle on the leased premises or located in a parking area provided by the landlord for tenants or tenants' guests. Added by Acts 2019, 86th Leg., R.S., Ch. 39 (H.B. 302), Sec. 7, eff. September 1, 2019. SUBCHAPTER G. REMEDIES
Under Texas Property Code § 94.257, a landlord who operates a manufactured home community cannot use lease terms or rules to ban tenants or their guests from lawfully possessing, carrying, transporting, or storing firearms, firearm parts, or ammunition inside the tenant's manufactured home, in vehicles parked in landlord-provided parking areas, or in any common areas that must be crossed to reach those locations. The restriction applies only where state or federal law does not independently prohibit the possession. This provision was added in 2019 and applies specifically to manufactured home lot rentals governed by Chapter 94 of the Texas Property Code.
Plain English — not legal advice.
Operators of manufactured home communities subject to Tex. Prop. Code § 94.257 generally review their lease agreements, community rules, and posted signage to ensure no provision purports to ban tenants or guests from the lawful possession, transport, or storage of firearms or ammunition in the spaces the statute protects. Compliant operators distinguish between areas where they retain discretion and the specific locations—the home itself, parking areas, and necessary transit routes—where § 94.257 limits their authority. Because the statute defers to state and federal law, operators also stay current on any independent legal prohibitions that may apply to specific locations or circumstances on their property.

Section 94.257 of the Texas Property Code gives tenants in manufactured home communities a statutory right to lawfully possess, carry, transport, and store firearms, firearm parts, and ammunition in their home, in their vehicle in a landlord-provided parking area, and along the routes necessary to reach those locations. If a lease clause or community rule purports to restrict those rights, tenants may have grounds to challenge the enforceability of that provision under § 94.257. Tenants who believe this right has been violated can consult a tenant-rights organization, a legal aid office, or a licensed Texas attorney to understand the options available under Subchapter G's remedies provisions.
