Operative Text
Construction and purposes of act. This act shall be construed liberally to promote the following policies: (1) to simplify, clarify, and modernize the law governing consumer sales practices; (2) to protect consumers from suppliers who commit deceptive and unconscionable sales practices, including by disgorging money or any thing of value obtained in violation of this chapter; (3) to encourage the development of fair consumer sales practices; (4) to make state regulation of consumer sales practices consistent with the policies of the Federal Trade Commission Act relating to consumer protection; (5) to make uniform the law, including the administrative rules, with respect to the subject of this chapter among those states that enact similar laws; and (6) to recognize and protect suppliers that in good faith comply with the provisions of this chapter.
Utah Code Ann. § 13-11-2 establishes the overarching goals and interpretive framework for Utah's Consumer Sales Practices Act. The law is designed to be read broadly in favor of protecting consumers from deceptive and unconscionable sales conduct, while also aligning Utah's rules with federal consumer protection standards and promoting uniformity with similar laws in other states. Suppliers who act in good faith and comply with the Act's requirements are explicitly recognized and protected under this provision.
Plain English — not legal advice.
Although § 13-11-2 is a general purpose and construction provision rather than a specific operational rule, it signals that courts and regulators will interpret the Consumer Sales Practices Act broadly against suppliers—including property managers and landlords who engage in consumer sales practices. Compliant operators generally ensure their leasing and sales communications are transparent, accurate, and consistent with both state and Federal Trade Commission consumer protection standards. Familiarity with this foundational provision helps property owners understand the spirit in which all other provisions of the Act will be applied.

Utah Code Ann. § 13-11-2 sets the interpretive tone for the entire Consumer Sales Practices Act, directing that it be read broadly to protect consumers from deceptive or unconscionable conduct by suppliers. Tenants who believe a landlord or property manager has engaged in such practices may find that this provision supports a broad reading of their rights under the Act. General enforcement paths can include filing a complaint with the Utah Division of Consumer Protection or consulting a tenant-rights organization to understand how the Act's policies may apply to a given situation.
