(2) (a) On motion of the division, or on the court's own motion, the court may impose a civil penalty of not more than $5,000 for each day a temporary restraining order, preliminary injunction, or permanent injunction issued under this chapter is violated, if the supplier received notice of the restraining or injunctive order. (b) Civil penalties imposed under this section shall be paid to the General Fund.
Utah Code Ann. § 13-11-7 establishes the responsibilities of the Utah Division of Consumer Protection in administering the state's consumer sales practices law. The division is charged with statewide enforcement, public education, complaint handling, and maintaining a public record of final judgments and consent orders. When a court-issued restraining or injunctive order under this chapter is violated by a supplier who had notice of it, a court may impose civil penalties of up to $5,000 for each day the violation continues, with those penalties going to the state's General Fund.

Property owners and managers who operate as suppliers of goods or services should be aware that under Utah Code Ann. § 13-11-7, the Utah Division of Consumer Protection actively enforces consumer protection requirements statewide and maintains a public file of final judgments and consent orders. Compliant operators generally ensure that any court-issued restraining or injunctive order received under this chapter is followed immediately and completely, since each day of non-compliance can trigger a separate civil penalty of up to $5,000. Operators typically keep records demonstrating their awareness of and adherence to any such orders to avoid escalating penalties.

Utah Code Ann. § 13-11-7 gives the Utah Division of Consumer Protection the authority to receive and act on consumer complaints, meaning tenants who believe a supplier has engaged in unlawful practices have a formal channel to report those concerns. The division is also required to inform the public about what conduct violates the chapter, and it maintains a public file of final judgments and consent judgments that tenants may review to learn about prior enforcement actions. Tenants who believe their rights under this chapter have been violated may consider filing a complaint with the division or consulting a tenant-rights organization to understand available options.
