Utah Code § 57-16 § 57-16-19
Violation of chapter by a mobile home park -- Remedies for a resident -- Attorney fees and costs.
Operative Text
Violation of chapter by a mobile home park -- Remedies for a resident -- Attorney fees and costs. (1) A mobile home park resident may bring a cause of action against a mobile home park for damages or injunctive relief arising from a violation of this chapter. (2) A court may award reasonable attorney fees and costs to the prevailing party in an action described in Subsection (1).
Utah Code Ann. § 57-16-19 establishes that when a mobile home park fails to comply with the requirements of Utah's mobile home park chapter, a resident has the right to pursue a civil lawsuit seeking monetary damages or a court order (injunctive relief) to stop or correct the violation. Courts handling such cases are also authorized to award reasonable attorney fees and costs to whichever party prevails. This provision creates a private enforcement mechanism, meaning residents themselves—not a government agency—are the primary enforcers of the chapter's protections.
Plain English — not legal advice.
Under Utah Code Ann. § 57-16-19, mobile home park operators face direct civil liability to residents for any violation of the mobile home park chapter, including potential exposure to the other party's attorney fees and court costs if the resident prevails. Compliant operators generally maintain thorough familiarity with all requirements of the chapter, document their practices carefully, and address resident concerns promptly to reduce the risk of litigation. Because attorney fee awards can significantly increase the financial stakes of any dispute, operators commonly work to resolve potential violations before they escalate to a lawsuit.

Utah Code Ann. § 57-16-19 gives mobile home park residents the right to file a civil lawsuit against a park that has violated any provision of Utah's mobile home park chapter, and to seek either financial compensation or a court order requiring the park to comply. If a resident prevails in such an action, the court has discretion to award reasonable attorney fees and costs, which can make legal representation more accessible. Residents who believe their park has violated the chapter may wish to document the issue thoroughly, consult a tenant-rights organization familiar with mobile home park law, or seek guidance from a licensed attorney about the range of options available under this provision.
