CVR 11-020-002 § 11
COMMON AREAS
Operative Text
11.1 Owner Responsibility. A mobile home park owner shall ensure that common areas and facilities are safe and maintained in a manner that ensures that residents can utilize them for their reasonably intended purpose. 11.2 Resident Responsibility. The resident shall not utilize common areas and facilities in a manner that will cause or prevent other residents from utilizing them for their reasonably intended purpose, nor disturb others’ peaceful enjoyment of the premises.
Under CVR 11-020-002, Section 11, mobile home park common areas and shared facilities must be kept safe and functional so that all residents can use them as intended. At the same time, individual residents are prohibited from using those spaces in ways that interfere with other residents' access or peaceful enjoyment. The rule establishes a dual layer of responsibility: one for the park owner and one for each resident.
Plain English — not legal advice.
CVR 11-020-002 Section 11.1 places the maintenance burden squarely on the park owner, meaning compliant operators routinely inspect common areas and facilities, address safety hazards promptly, and keep shared spaces in a condition that supports their intended use. Documenting inspection schedules and repair histories is a practice commonly associated with demonstrating ongoing compliance. Operators also generally establish clear community rules that reinforce resident obligations under Section 11.2.

Under CVR 11-020-002 Section 11.1, residents have a right to safe, functional common areas maintained by the park owner, and Section 11.2 extends a corresponding responsibility to each resident not to interfere with neighbors' use or peaceful enjoyment. If a common area is unsafe or unusable, residents may consider documenting the condition and raising the issue in writing with park management. Vermont tenant-rights organizations and the state's mobile home park dispute resolution processes are among the general paths available to residents who believe this provision is not being followed.
