CVR 11-020-002 § 8
SEWAGE DISPOSAL
Operative Text
8.1 Owner Responsibility. Mobile home park owners are required to provide every mobile home park lot with adequate wastewater disposal that is properly connected to a public sewage system or properly operating subsurface disposal system. A proper disposal system is one that does not affect the potability of the water supply, one that does not cause the wastewater to surface above ground, and one that does not cause backup into any mobile home. Owners are responsible for ensuring that the sewage disposal system is serviced adequately to prevent surfacing or back-up. Owners are responsible for the maintenance of the sewage disposal system to the point where it surfaces from the ground to service the mobile home. 8.2 Resident Responsibility. The leaseholder shall ensure that the mobile home is properly connected to the mobile home park’s wastewater disposal system. Residents shall ensure that the appliances, faucets and toilets within the mobile home are free from leaks, and shall not dispose of anything other than normal domestic wastewater in the wastewater system. Residents shall be responsible for damage caused by failing to comply with these requirements.
CVR 11-020-002 § 8 establishes a split responsibility framework for sewage disposal in Vermont mobile home parks. The park owner must supply each lot with a properly functioning wastewater system—connected to either a public sewer or a working subsurface system—that keeps sewage underground and out of homes. The resident, in turn, must keep the home's internal plumbing leak-free, connect properly to the park's system, and limit what goes into it to normal domestic wastewater.

Under CVR 11-020-002 § 8, mobile home park operators are generally expected to maintain the wastewater infrastructure from the point it exits the ground to serve each lot, ensuring it is connected to an approved public or subsurface system and serviced regularly enough to prevent surfacing or backup. Compliant operators typically conduct routine inspections of the disposal system, address signs of failure promptly, and keep records of service and maintenance. Because the rule draws the ownership boundary at the point where the system surfaces from the ground, operators commonly clarify that boundary in lease agreements to avoid ambiguity with residents.

CVR 11-020-002 § 8 gives residents clear rights to a properly functioning sewage disposal system provided and maintained by the park owner up to the point the system reaches the home. If a resident experiences sewage backup or surfacing that appears to stem from the park's infrastructure, that may constitute a violation of the owner's obligations under this provision, and residents can document the condition and report it to Vermont's relevant housing or environmental regulatory authorities. Tenant-rights organizations familiar with Vermont mobile home park law can help residents understand the options available, including raising a violation as a defense in certain proceedings.
