18 V.S.A. § ___ § 4466
Inspection
Operative Text
(a) The Commissioner may inspect through his or her duly authorized officers, inspectors, agents, or assistants, at all reasonable times, a short-term rental and the operator’s records related to the short-term rental. (b) Whenever an inspection demonstrates that the short-term rental is not operated in accordance with applicable provisions of this chapter, the officer, inspector, agent, or assistant shall notify the operator of the conditions found and shall direct necessary changes. (c) Nothing in this section shall be construed to supersede the authority and responsibilities of the Division of Fire Safety. The Division’s Executive Director shall inform the Commissioner in a timely manner of any enforcement actions that the Division has taken against the operator of a short-term rental. (Added 2018, No. 10 (Sp. Sess.), § 1; amended 2019, No. 14, § 49, eff. April 30, 2019.)
Under 18 V.S.A. ch. 85 § 4466, Vermont's Commissioner of Health has the authority to inspect short-term rentals and review related operator records at reasonable times. If an inspection reveals that a short-term rental is not meeting the chapter's requirements, the inspecting official must inform the operator of the deficiencies and direct that corrections be made. This provision also preserves the separate authority of the Division of Fire Safety, which is required to keep the Commissioner informed of any enforcement actions it takes against short-term rental operators.
Plain English — not legal advice.
Operators of short-term rentals in Vermont should be aware that under 18 V.S.A. ch. 85 § 4466, authorized representatives of the Commissioner may conduct inspections of the rental property and review associated business records during reasonable hours. Compliant operators generally maintain accurate and accessible records and keep their properties in conformance with the applicable provisions of Chapter 85 so that any identified deficiencies can be promptly addressed. It is also worth noting that the Division of Fire Safety retains its own independent enforcement authority over short-term rentals, meaning operators may be subject to oversight from more than one agency.
