24 V.S.A. § ___ § 5007
Penalties
Operative Text
Municipalities may prescribe by ordinance penalties for any violation of any ordinance or regulation adopted under this chapter by a fine not to exceed $200.00 or by imprisonment for not more than 30 days, or both, for each violation thereof. Each day’s failure to comply with any such provision shall constitute a separate violation. (Added 1969, No. 270 (Adj. Sess.).)
Under 24 V.S.A. ch. 123 § 5007, Vermont municipalities have the authority to establish local penalties for violations of housing ordinances or regulations adopted under this chapter. Those penalties may include a fine of up to $200, imprisonment of up to 30 days, or both. Critically, each day that a violation continues is treated as a separate, independent violation, meaning penalties can accumulate over time.

Property owners and managers subject to local ordinances adopted under 24 V.S.A. ch. 123 § 5007 should be aware that non-compliance can result in daily fines of up to $200, potential imprisonment, or both. Because each day of continued non-compliance constitutes its own violation, operators who promptly address and correct any cited deficiency generally limit their total exposure. Keeping records of corrective actions and communicating with the local municipality can help demonstrate good-faith efforts toward compliance.

Under 24 V.S.A. ch. 123 § 5007, tenants living in municipalities that have adopted local housing ordinances may have recourse when a landlord is in violation of those rules. Because each day of non-compliance is treated as a separate violation, ongoing issues can give rise to accumulating penalties against a non-compliant property owner. Tenants who believe a violation is occurring may consider contacting their local municipal office or a tenant-rights organization to understand what complaint or enforcement processes are available in their community.
