27 V.S.A. § ___ § 1352
Conversion of manufactured home parks permitted
Operative Text
A manufactured home park may not be converted except in accordance with this subchapter. For the purpose of this subchapter, the provisions of subdivision 1302(1) of this title shall not be construed to prevent the conversion of a manufactured home park. Any sale of a manufactured home park shall be governed by the provisions of 10 V.S.A. § 6242; the conversion of a manufactured home park under this subchapter shall not be deemed to be a sale. (Added 1993, No. 97, § 1.)
Under 27 V.S.A. ch. 15 § 1352, a manufactured home park in Vermont cannot be converted unless the process follows the specific rules laid out in the same subchapter. The provision also clarifies that the general definition in § 1302(1) does not block a park conversion, and that a conversion under this subchapter is legally distinct from a sale—meaning the sale-related requirements of 10 V.S.A. § 6242 apply only to actual sales, not to conversions. This distinction shapes which procedural rules apply depending on whether a park is being sold or converted.
Plain English — not legal advice.
Operators and owners of manufactured home parks in Vermont should be aware that 27 V.S.A. ch. 15 § 1352 establishes a clear boundary between a park conversion and a park sale. A compliant operator pursuing a conversion follows the procedures set out in the subchapter rather than the sale-specific requirements of 10 V.S.A. § 6242, since the statute explicitly states that a conversion is not deemed a sale. Owners considering either a sale or a conversion generally review both sets of statutory requirements carefully to ensure the correct process is followed for the transaction type at hand.

For residents of manufactured home parks in Vermont, 27 V.S.A. ch. 15 § 1352 provides a foundational protection: any conversion of the park must comply with the full subchapter, meaning a park owner cannot bypass the conversion rules by characterizing the transaction differently. Tenants who believe a park conversion is proceeding outside the requirements of this subchapter may have grounds to raise that concern as a legal issue. Consulting a tenant-rights organization or legal aid service familiar with Vermont manufactured housing law can help residents understand what protections apply to their specific park under this provision.
