27 V.S.A. § ___ § 1361
Enforcement
Operative Text
(a) A rent increase greater than that provided for by section 1360 of this subchapter is unenforceable to the extent the increase exceeds that provided for in that section. (b) A declarant or site purchaser shall not commence eviction proceedings against a leaseholder for nonpayment of the part of the lot rent which represents an increase in excess of that provided for in section 1360 of this subchapter. (Added 1993, No. 97, § 1.)
Under 27 V.S.A. ch. 15 § 1361, any rent increase that exceeds the cap established by section 1360 of the same subchapter is legally unenforceable to the degree it surpasses that limit. Additionally, a declarant or site purchaser is prohibited from initiating eviction proceedings against a leaseholder solely because the leaseholder has not paid the portion of lot rent that represents an above-cap increase. The provision effectively nullifies the excess portion of an impermissible rent increase and removes it as a basis for eviction.
Plain English — not legal advice.
Operators subject to 27 V.S.A. ch. 15 § 1361 generally ensure that any lot rent increase they implement stays within the ceiling set by section 1360, since any amount above that ceiling cannot be collected or enforced. Compliant declarants and site purchasers refrain from filing eviction actions when a leaseholder's nonpayment is limited to the disallowed excess portion of a rent increase. Keeping rent adjustments within the statutory limits is the standard practice for avoiding the unenforceability consequences described in this provision.

Under 27 V.S.A. ch. 15 § 1361, leaseholders in covered mobile home or land-lease communities have a statutory protection against both the collection of above-cap rent increases and eviction proceedings based on nonpayment of those excess amounts. If a declarant or site purchaser attempts to evict a leaseholder for refusing to pay a portion of lot rent that exceeds the section 1360 limit, that eviction action may be challenged on the grounds that the excess increase is unenforceable.
