W. Va. Code §§ 24D-2-1 to 24D-2-10 § 24D-2-10
Exception.
Operative Text
Notwithstanding any provision in this article to the contrary, a landlord and cable operator may by mutual agreement establish the terms and conditions upon which cable television facilities are to be installed within a multiple dwelling premises without having to comply with the provisions of this article.
West Virginia Code § 24D-2-10 creates an exception to the standard cable access rules established elsewhere in Article 2. When a landlord and a cable operator reach a mutual agreement, they may set their own terms and conditions for installing cable television facilities in a multi-unit residential building, bypassing the default requirements of the article. This exception applies only when both parties — the landlord and the cable operator — voluntarily enter into such an agreement together.
Plain English — not legal advice.
Under § 24D-2-10, property owners who choose to negotiate directly with a cable operator have the flexibility to craft installation terms that differ from the article's standard requirements. A compliant operator pursuing this path generally ensures that any such arrangement is documented as a mutual agreement with the cable operator, covering the specific terms and conditions of installation. Landlords who do not enter into such an agreement remain subject to the default provisions of Article 2.

Section § 24D-2-10 means that if your landlord has entered into a mutual agreement with a cable operator, the standard tenant protections and procedures outlined in Article 2 may not apply to your building's cable installation situation. Tenants in buildings where such an agreement exists may want to inquire whether one is in place, as it can affect the terms under which cable services are made available. Tenant-rights organizations familiar with West Virginia housing law can help explain how this exception may interact with other rights under Chapter 24D.
