§64-40-15. Supervision. 15.1. The person to whom a permit to operate a manufactured home community is issued shall operate the manufactured home community in compliance with all applicable provisions of this rule, all other laws and regulations applicable thereto, and shall provide supervision to maintain the manufactured home community and its facilities and equipment in good repair and in a clean and sanitary condition. 15.2. A manufactured home shall not be occupied for dwelling purposes unless it is properly placed on an approved manufactured home site and is properly connected to water, sewage, and other essential utilities.
West Virginia regulation W. Va. C.S.R. § 64-40-15 establishes two core requirements for manufactured home communities. First, the permit holder must operate the community in compliance with all applicable rules and laws, and must actively supervise the maintenance of facilities and equipment to keep them in good repair and sanitary condition. Second, no manufactured home may be used as a dwelling unless it is properly placed on an approved site and fully connected to water, sewage, and other essential utilities.

Under W. Va. C.S.R. § 64-40-15, the permit holder for a manufactured home community is responsible for ongoing supervision of the property's facilities and equipment, ensuring they remain in good repair and sanitary condition. Compliant operators typically conduct regular inspections, address maintenance issues promptly, and verify that each home is placed on an approved site with proper connections to water, sewage, and other essential utilities before allowing occupancy. Keeping documentation of inspections, utility connections, and site approvals is a practice commonly associated with meeting the supervision obligations outlined in this section.

W. Va. C.S.R. § 64-40-15 gives residents of manufactured home communities a basis to expect that their community's facilities and equipment will be maintained in good repair and sanitary condition under the permit holder's supervision. Tenants also have a right to expect that their home is situated on an approved site with proper utility connections before occupancy is permitted. Those who believe these standards are not being met may consider contacting the West Virginia Bureau for Public Health, which oversees manufactured home community regulations, or reaching out to a tenant-rights organization to understand available options.
