§64-40-16. Miscellaneous Requirements. 16.1. The operator of a manufactured home community shall make available to the incoming occupants of the manufactured home community a copy of this rule to inform them of their duties and responsibilities under this rule. 16.2. West Virginia regulation W. Va. C.S.R. § 64-40-16 establishes several miscellaneous obligations for manufactured home communities. Community operators are required to provide incoming residents with a copy of the governing rule so residents understand their responsibilities. Operators may also set additional community-specific rules, provided those rules do not conflict with the state regulation, and all residents who own pets must comply with applicable laws.

Under W. Va. C.S.R. § 64-40-16, compliant manufactured home community operators typically maintain copies of the state rule on hand and distribute them to new occupants at or before move-in. Operators who wish to impose supplemental community standards—such as quiet hours or parking policies—generally ensure those additional requirements are reviewed against the state rule to confirm there is no conflict. Keeping documentation of rule distribution and any community-specific policies can support consistent, transparent operations.

W. Va. C.S.R. § 64-40-16 gives incoming residents of a manufactured home community the right to receive a copy of the state rule that governs the community, so they can understand both their own responsibilities and the operator's obligations. If a community operator imposes additional rules, those rules cannot override or conflict with the state regulation. Residents who believe they were not provided required disclosures, or that supplemental community rules improperly conflict with § 64-40-16, may consider reaching out to a local tenant-rights organization or the West Virginia Department of Health, which oversees this regulation, to explore available options.
