Operative Text
§64-40-4. Design, Construction, Installation, Maintenance, and Operation of Manufactured Home Communities. 4.1. In addition to meeting all applicable provisions of this rule, all manufactured home communities constructed or installed after the effective date of this rule, shall be constructed or installed in accordance with the plans, specifications, and instructions issued by the Commissioner. 4.2. West Virginia Code of State Rules § 64-40-4 establishes baseline standards for manufactured home communities in the state. Any community built or installed after the rule's effective date must follow plans, specifications, and instructions issued by the Commissioner, in addition to all other applicable provisions of the rule. The rule applies broadly to the full lifecycle of a manufactured home community — from initial design and construction through ongoing maintenance and operation.
Plain English — not legal advice.
Operators and developers of manufactured home communities in West Virginia must ensure that every phase of a community's existence — design, construction, installation, maintenance, and operation — conforms to the requirements set out under § 64-40-4. For communities established after the rule's effective date, compliant operators also obtain and follow the plans, specifications, and instructions issued by the Commissioner before breaking ground or installing infrastructure. Keeping documentation of compliance with Commissioner-issued instructions is a practice commonly associated with meeting these obligations.

Residents of manufactured home communities in West Virginia have an interest in knowing that § 64-40-4 requires their community to meet state standards across design, construction, installation, maintenance, and operation. If conditions in a community appear to fall short of these standards, tenants may consider contacting the West Virginia Bureau for Public Health or a local tenant-rights organization to understand what oversight mechanisms are available. Raising a potential violation with the appropriate state agency is one general path available to residents who believe these requirements are not being met.
