Operative Text
§64-40-6. Inspection. 6.1. Each manufactured home community shall be inspected once a year. The health officer shall also make as many additional inspections of the manufactured home community as he or she considers necessary to determine satisfactory compliance with the provisions of this rule and any orders, notices, instructions, or specifications issued pursuant to this rule. 6.2. A copy of the inspection report shall be filed with the manufactured home community operator.
Under W. Va. C.S.R. § 64-40-6, every manufactured home community in West Virginia must receive at least one formal inspection per year conducted by the health officer. Beyond that annual visit, the health officer may conduct additional inspections whenever deemed necessary to verify compliance with the rule or any related orders, notices, or instructions. A copy of each inspection report must be provided to the community operator.
Plain English — not legal advice.
Under § 64-40-6, operators of manufactured home communities should expect at least one scheduled annual inspection by the health officer, as well as the possibility of unannounced follow-up inspections if compliance questions arise. Compliant operators generally maintain records of prior inspection reports, address any cited deficiencies promptly, and keep the community in a condition that meets the standards outlined in this rule. Retaining copies of all inspection reports filed pursuant to § 64-40-6 supports an organized compliance history.

Section 64-40-6 establishes that residents of manufactured home communities benefit from a mandatory annual inspection by the health officer, with additional inspections possible when compliance concerns exist. If a tenant believes conditions in their community are not meeting applicable standards, they may contact the local health department to inquire about recent inspection reports or request that an inspection be conducted. Tenant-rights organizations familiar with West Virginia housing regulations can also help residents understand what inspection findings mean and what general options may be available.
