West Virginia Code Chapter 8, Article 42 — Accessory Dwelling Units

Art. 8-42, Accessory Dwelling Units (3 sections): a municipality may not prohibit or restrict at least one accessory dwelling unit by right on a lot with a single-family dwelling (§ 8-42-2), non-complying ordinances in effect on or after January 1, 2027 are invalid, and municipal regulation of short-term rentals is expressly preserved (§ 8-42-3).
