Cal. Civ. Code § ATCP 134.07
Promises to repair.
Operative Text
ATCP 134.07 Promises to repair. (1) Date of completion. Every promise or representation made by a landlord to a tenant or prospective tenant to the effect that the dwelling unit or any other portion of the premises, including furnishings or facilities, will be cleaned, repaired or otherwise improved by the landlord shall specify the date or time period on or within which the cleaning, repairs or improvements are to be completed. (2) Initial promises in writing. All promises made before the initial rental agreement shall be in writing with a copy furnished to the tenant. (3) Performance; unavoidable delays. No landlord shall fail to complete the promised cleaning, repairs or improvements on the date or within the time period represented under sub. (1), unless the delay is for reason of labor stoppage, unavailability of supplies or materials, unavoidable casualties, or other causes beyond the landlord’s control. The landlord shall give timely notice to the tenant of reasons beyond the landlord’s control for any delay in performance, and stating when the cleaning, repairs or improvements will be completed.
Wisconsin Administrative Code § ATCP 134.07 governs promises landlords make about cleaning, repairing, or improving a rental unit or its facilities. Any such promise must include a specific completion date or time period, and promises made before the initial lease must be put in writing with a copy given to the tenant. Landlords are required to follow through by the stated deadline unless a qualifying circumstance beyond their control—such as a labor stoppage or unavailability of materials—causes a delay, in which case timely written notice of the delay and a new expected completion date must be provided.
Plain English — not legal advice.
Under § ATCP 134.07, compliant operators document every repair or improvement promise with a clear completion date or time window before any work is agreed upon. Promises made prior to signing the initial rental agreement must be reduced to writing and a copy delivered to the prospective tenant. When an unavoidable delay arises—such as a supply shortage or labor stoppage—operators generally notify the tenant promptly in writing, explaining the reason and providing a revised completion timeline.

Wisconsin Administrative Code § ATCP 134.07 gives tenants the right to receive written repair or improvement promises with specific completion dates before signing an initial lease. If a landlord fails to meet a promised deadline without a qualifying excuse and proper notice, that failure may constitute a violation of the administrative code. Tenants who believe a landlord has not honored a repair promise under § ATCP 134.07 can document the original promise and any missed deadlines, and may explore options such as filing a complaint with the Wisconsin Department of Agriculture, Trade and Consumer Protection or consulting a tenant-rights organization for guidance on available remedies.
