Cal. Civ. Code § SPS 326.33
Deposits for water and sewer service.
Operative Text
SPS 326.33 Deposits for water and sewer service. (1) A manufactured home community operator or manufactured home community contractor may require a deposit as a condition of new or continued water and sewer service. The amount of the required deposit may not exceed $75. (2) The manufactured home community operator or manufactured home community contractor shall refund the water and sewer deposit of a manufactured home community occupant within the same period as for the rental agreement security deposit. (3) (a) Any arrearage owed by a manufactured home community occupant for water and sewer service may be deducted from the manufactured home community occupant’s water and sewer deposit. (b) If the manufactured home community operator or manufactured home community contractor deducts a water and sewer arrearage from a manufactured home community occupant’s deposit, it may require the manufactured home community occupant to bring the water and sewer deposit up to its original amount.
Under Wis. Admin. Code § SPS 326.33, manufactured home community operators and contractors may collect a deposit from occupants as a condition of receiving or continuing water and sewer service, but that deposit cannot exceed $75. When service ends, the deposit must be refunded within the same timeframe that applies to rental security deposits. If an occupant owes unpaid water and sewer charges, those arrearages may be deducted from the deposit, and the operator may then require the occupant to restore the deposit to its original amount.
Plain English — not legal advice.
Under § SPS 326.33, compliant manufactured home community operators and contractors keep water and sewer deposits at or below the $75 statutory cap and document the deposit amount at the time of collection. Refunds are issued within the same window required for rental agreement security deposits, and any deductions for unpaid water and sewer charges are clearly documented. When a deduction is made, operators who wish to restore the deposit to its original level must formally notify the occupant of that requirement.

Wis. Admin. Code § SPS 326.33 limits the water and sewer deposit a manufactured home community operator or contractor can collect to no more than $75, and entitles occupants to a refund on the same schedule as a rental security deposit. If a deduction is made for unpaid water or sewer charges, the operator may ask that the deposit be replenished, but occupants have the right to know the basis for any such deduction. Tenants who believe a deposit was improperly withheld or exceeded the cap may consult a tenant-rights organization or review Wisconsin's administrative complaint processes for potential next steps.
