Wyo. Stat. Ann. § 15-7-516 § 15-7-516
Conditions on the connection of municipal sewer service.
Operative Text
15-7-516. Conditions on the connection of municipal sewer
service.
(a) Notwithstanding any provision of law to the contrary,
no city or town shall condition the connection of a municipal
sewer system to a property on the inclusion of any deed
restriction for that property or any other property that
requires the development or provision of affordable housing.
Nothing herein shall contravene the discretion of cities and
towns to deny connection to the municipal sewerage system.
(b) As used in this section, "affordable housing" means
residential housing that is rented to or owned by a person who
qualifies as a low income or moderate income household, however
defined.Wyoming Statute § 15-7-516 prohibits cities and towns from making sewer hookups conditional on a property owner agreeing to deed restrictions that mandate affordable housing development or provision, whether on the property being connected or any other property. The law defines 'affordable housing' as housing rented or owned by low- or moderate-income households. Importantly, the statute preserves municipal authority to deny sewer connections outright for other legitimate reasons — it only limits the specific practice of attaching affordable-housing deed restrictions as a condition of connection.
Plain English — not legal advice.
Under Wyo. Stat. § 15-7-516, a compliant municipality cannot require a property owner to accept an affordable-housing deed restriction — on the subject property or any other — as a prerequisite for connecting to the municipal sewer system. Property owners and developers who encounter such a condition being imposed as part of a sewer connection approval process may have grounds to challenge it under this statute. Operators generally document all conditions placed on sewer connection requests so that any impermissible requirements can be identified and addressed.

Wyo. Stat. § 15-7-516 shapes how affordable housing can be created or required in Wyoming municipalities by limiting the tools cities and towns may use to incentivize or mandate it through sewer connection approvals. Because this provision restricts a municipal land-use mechanism rather than directly governing rental terms, its effects on tenants are indirect — it may influence the supply of deed-restricted affordable units in a community. Tenants interested in how this provision affects housing availability in their area may find it useful to consult a tenant-rights organization or review local housing policy resources for context.
