Wyo. Stat. Ann. §§ 1-21-403, 1-21-1001 to 1-21-1017, 1-21-1201 to 1-21-1211, 1-21-1301 to 1-21-1304, 1-21-1401 to 1-21-1403 § 1-21-1209
Holder of owner's interest bound by provisions.
Operative Text
1-21-1209. Holder of owner's interest bound by provisions. The holder of the interest of the owner or designated agent in the residential rental unit at the time of termination of the rental agreement shall be bound by the provisions of W.S. 1-21-1207 and 1-21-1208.
Wyoming Statute § 1-21-1209 establishes that whoever holds the ownership interest in a residential rental unit—or acts as the designated agent for that owner—at the moment a rental agreement ends is the party responsible for complying with the security deposit obligations set out in §§ 1-21-1207 and 1-21-1208. This means that if ownership or management of a property changes hands around the time a tenancy concludes, the person or entity holding that interest at termination cannot escape the deposit-related duties by pointing to a prior owner or agent. The rule effectively ties the legal obligation to the status of the holder at a specific point in time: the termination of the rental agreement.
Plain English — not legal advice.
Property owners and managers operating under Wyoming Statute § 1-21-1209 should be aware that whoever holds the ownership interest or serves as designated agent at the moment a rental agreement terminates bears full responsibility for the security deposit duties described in §§ 1-21-1207 and 1-21-1208. Compliant operators who acquire a property or take over management mid-tenancy typically confirm the status of any existing security deposits and ensure proper documentation is in place before the tenancy concludes. When a sale or transfer of a rental property is anticipated, parties generally address security deposit obligations explicitly in their transaction agreements to clarify which party will be the holder at termination.

Under Wyoming Statute § 1-21-1209, tenants have the assurance that the security deposit protections in §§ 1-21-1207 and 1-21-1208 remain enforceable against whoever holds the ownership interest at the time the rental agreement ends—even if the property changed hands during the tenancy. If a tenant believes the holder of the owner's interest has failed to meet those deposit obligations, options may include raising the violation in small claims court, consulting a tenant-rights organization familiar with Wyoming law, or seeking guidance from a licensed attorney. Keeping records of any ownership or management changes, along with all deposit-related communications, can be useful when pursuing these general enforcement paths under § 1-21-1209.
