Wyoming Statute § 1-21-1211 establishes two distinct remedies available to property owners when a renter fails to comply with a court-ordered eviction or causes damage to a rental unit. First, if a renter does not leave after a court order is issued under Wyoming's eviction statutes, the sheriff is authorized to physically remove the renter's belongings and bar reentry without requiring additional court proceedings. Second, if a renter causes damage to the property, the owner may apply any security deposit toward those damages, and the renter remains financially responsible for any costs exceeding the deposit, with interest accruing at 10% per year on unpaid balances.

For Property Managers

Under § 1-21-1211, property owners who have obtained a valid court eviction order do not need to return to court to have the sheriff enforce removal if the renter refuses to vacate — the sheriff can act on the existing order. When damage to the unit occurs, compliant operators document losses carefully, apply the security deposit in accordance with § 1-21-1208(a), and pursue any remaining balance through available legal channels, including civil court. Keeping thorough records of the unit's condition before and after tenancy supports any claim for damages plus the statutory 10% annual interest on unpaid amounts.

For Tenants

Under § 1-21-1211, once a court has issued an eviction order through the process outlined in Wyoming's eviction statutes, the sheriff has authority to enforce that order without a separate court action, so understanding the timeline of any court proceedings is important. Regarding deposits and damages, the statute limits how an owner may apply a deposit to claimed damages — the rules in § 1-21-1208(a) govern that process — and tenants who believe a deposit was improperly applied may have grounds to raise that as an issue in court. Tenants facing eviction or deposit disputes may benefit from contacting a local tenant-rights organization or legal aid office familiar with Wyoming's residential rental statutes.
