Prohibition of waiver or modification.
Operative Text
1-21-1304. Prohibition of waiver or modification. The provisions of this act shall not be waived or modified in any lease or separate agreement between a landlord and tenant.
Wyoming's Wyo. Stat. § 1-21-1304 establishes that the protections and requirements set out in the broader residential rental statutes cannot be contracted away. Any lease clause or side agreement that attempts to waive or alter these statutory rights is unenforceable as a matter of law.
Plain English — not legal advice.
Under Wyo. Stat. § 1-21-1304, operators who include lease provisions that purport to waive or limit tenant rights under the Wyoming residential rental statutes risk having those clauses deemed void. Compliant landlords generally review their lease templates to ensure no language attempts to override the statutory framework established in Wyo. Stat. §§ 1-21-1001 through 1-21-1304.

Wyo. Stat. § 1-21-1304 means that even if a lease contains language asking a tenant to give up rights granted by Wyoming's residential rental statutes, that language carries no legal force. Tenants who believe a landlord is relying on such a waiver clause may consider raising the statute as a defense or consulting a tenant-rights organization familiar with Wyoming law.
