Wyo. Stat. Ann. §§ 40-26-101 to 40-26-145 § 40-26-108
Residential real estate related transaction.
Operative Text
40-26-108. Residential real estate related transaction. A person whose business includes engaging in residential real estate related transactions may not discriminate against an individual in making a real estate related transaction available or in the terms or conditions of a real estate related transaction because of race, color, religion, sex, disability, familial status or national origin. A residential real estate related transaction is the selling, brokering or appraising of residential real property or the making or purchasing of loans or the provision of other financial assistance to purchase, construct, improve, repair, maintain a dwelling, or to secure residential real estate. Nothing in this section prohibits a person engaged in the business of furnishing appraisals of real property to take into consideration factors other than race, color, religion, sex, disability, familial status or national origin.
Wyoming Statute § 40-26-108 prohibits businesses involved in residential real estate transactions—such as lenders, brokers, and appraisers—from discriminating on the basis of race, color, religion, sex, disability, familial status, or national origin. This applies both to whether a transaction is made available at all and to the specific terms or conditions offered. Appraisers, however, are expressly permitted to consider legitimate, non-protected factors when valuing real property.
Plain English — not legal advice.
Property owners and managers who participate in residential real estate related transactions—including securing financing, refinancing, or arranging appraisals—operate in compliance with § 40-26-108 by ensuring that protected characteristics play no role in the availability or terms of those transactions. Compliant operators typically maintain consistent underwriting and transaction criteria applied uniformly regardless of an applicant's race, color, religion, sex, disability, familial status, or national origin. Documenting the objective, non-discriminatory bases for any transaction decisions is a common practice among operators seeking to demonstrate adherence to this provision.

Under § 40-26-108, individuals seeking home purchase loans, refinancing, or other residential real estate financial assistance have a right to be evaluated without regard to race, color, religion, sex, disability, familial status, or national origin. If a person believes they were denied a loan, offered less favorable terms, or otherwise treated differently in a real estate transaction because of a protected characteristic, options may include filing a complaint with a state or federal fair housing agency or consulting a tenant- or consumer-rights organization familiar with Wyoming fair housing law. The Wyoming statutes at §§ 40-26-101 through 40-26-145 provide the broader framework within which § 40-26-108 operates, and understanding that context can help individuals assess what remedies may be available.
