Wyo. Stat. Ann. §§ 40-26-101 to 40-26-145 § 40-26-123
Temporary or preliminary relief.
Operative Text
40-26-123. Temporary or preliminary relief. The enforcing authority may authorize a claim for relief for temporary or preliminary relief pending the final disposition of a complaint, if the enforcing authority concludes after the filing of the complaint that prompt judicial action is necessary to carry out the purposes of this chapter. A temporary restraining order or other order granting preliminary or temporary relief under this section is governed by the applicable statutes and the Wyoming Rules of Civil Procedure. The filing of a claim for relief under this section does not affect the initiation or continuation of administrative proceedings under W.S. 40-26-131.
Wyoming Statute § 40-26-123 allows the enforcing authority overseeing housing complaints to seek emergency or preliminary court relief before a complaint is fully resolved. If the enforcing authority determines that waiting for a final decision would undermine the purposes of the fair housing chapter, it may pursue a temporary restraining order or similar judicial remedy. Any such court order is governed by Wyoming's civil procedure rules and applicable statutes, and pursuing this judicial relief does not pause or prevent related administrative proceedings from moving forward.
Plain English — not legal advice.
Under § 40-26-123, a housing complaint filed against a property owner or manager can trigger not only an administrative process but also a request for emergency court intervention before that process concludes. Operators who maintain documented, consistent compliance practices are generally better positioned when an enforcing authority evaluates whether prompt judicial action is warranted. Because administrative proceedings under W.S. 40-26-131 continue independently of any court action sought under this section, a compliant operator should be prepared to respond on both tracks simultaneously.

Section § 40-26-123 of Wyoming's fair housing statutes provides a mechanism through which the enforcing authority can seek urgent court relief on behalf of complainants when waiting for a final administrative outcome could cause harm. If you have filed a housing complaint and believe the situation is time-sensitive, you may wish to ask the enforcing authority whether preliminary relief under this provision is appropriate to your circumstances. Tenant-rights organizations familiar with Wyoming fair housing law can help explain how this section interacts with the administrative complaint process under W.S. 40-26-131.
