Syracuse, N.Y., Local Laws ch. 8 § 8-2
Equality of opportunity a civil right
Operative Text
The opportunity to obtain employment without discrimination based upon sexual or affectional preference or orientation and/or actual or perceived sex, or gender identity or expression, as specific in this law, is hereby recognized as and declared to be a civil right. The opportunity for the use and occupancy of housing accommodation without discrimination based on legal sources of income upon which a person may rely to pay housing costs, as specified in this law, is hereby recognized as and declared to be a civil right. The opportunity to obtain education, the use of places of public accommodation and the ownership, use and occupancy of housing accommodation and commercial space without discrimination based upon sexual or affectional preference or orientation and/or actual perceived sex, or gender identity or expression, as specified in this law, is hereby recognized as and declared to be a civil right.
Syracuse Local Laws ch. 8 § 8-2 formally declares that access to housing, employment, education, and public accommodations is a civil right that cannot be denied based on sexual or affectional preference or orientation, actual or perceived sex, gender identity or expression, or legal sources of income used to pay housing costs. This provision establishes the foundational policy framework for the anti-discrimination protections that follow in the rest of the law. By naming these characteristics as protected, the provision signals that any denial of housing occupancy or use on these grounds is treated as a civil rights violation under Syracuse law.
Plain English — not legal advice.
Under Syracuse Local Laws ch. 8 § 8-2, property owners and managers operating in Syracuse are subject to a legal framework that treats equal access to housing as a civil right, not merely a policy preference. Compliant operators generally ensure that their tenant screening, leasing, and occupancy practices do not treat applicants differently based on gender identity, sexual orientation, or the type of lawful income—such as housing vouchers or public assistance—an applicant uses to pay rent. Familiarity with the full scope of ch. 8 is important, as § 8-2 sets the civil-rights foundation upon which the rest of the law's specific requirements and enforcement mechanisms are built.
