Plain English

White Plains Mun. Code ch. 9-8 § 9-8-1 establishes local protections against eviction without good cause by adopting New York State's Article 6-A of the Real Property Law. Under this provision, rental units with a monthly rent exceeding 345% of the HUD-published fair market rent for Westchester County are exempt from these protections. Additionally, the provision defines a 'small landlord' as one who owns no more than four units anywhere in New York State, a classification that carries its own significance under the broader Chapter 9-8 framework.

For Property Managers

Under White Plains Mun. Code ch. 9-8 § 9-8-1, operators of rental housing in White Plains are subject to a good-cause eviction standard unless a specific exemption applies. Compliant operators generally track the current HUD fair market rent figures for Westchester County, as published by the New York State Division of Housing and Community Renewal, to determine whether any of their units exceed the 345% rent threshold that triggers an exemption. Landlords who own four or fewer units statewide should be aware that they fall within the 'small landlord' definition established by this section, which may affect how other provisions of Chapter 9-8 apply to them.

For Tenants

White Plains Mun. Code ch. 9-8 § 9-8-1 gives tenants in qualifying units the right not to be evicted without good cause, as defined under New York's Article 6-A of the Real Property Law. Tenants whose monthly rent is at or below 345% of the HUD fair market rent for Westchester County may be covered by these protections, while those paying above that threshold may not be. Tenants who believe a landlord has not complied with this provision can look into raising the violation as a defense in eviction proceedings, filing a complaint with the New York State Division of Housing and Community Renewal, or reaching out to a local tenant-rights organization for general guidance.
